Additive Manufacturing, Product Use, Inspection, Assumption of Risk & Limitation of Liability
Many GEAR182 products are manufactured using advanced additive manufacturing (commonly known as 3D printing). This manufacturing process allows us to produce durable, lightweight, and innovative products while maintaining strict quality control throughout production. Although every product is inspected before shipment, additive manufacturing differs from traditional manufacturing methods and may exhibit characteristics that are normal to the process, including minor cosmetic variations, layer lines, surface texture differences, dimensional tolerances, or slight colour variations. These characteristics do not affect the intended function of the product and are not considered manufacturing defects.
Despite careful design, material selection, quality control, and inspection procedures, no manufactured product can be guaranteed to be free from failure under all circumstances. Products manufactured using additive manufacturing may, in rare cases, experience cracking, separation between printed layers, hardware loosening, deformation, or other forms of mechanical failure resulting from wear, repeated loading, misuse, accidental impact, environmental exposure, improper storage, chemical exposure, excessive heat, ultraviolet light, modification, improper installation, manufacturing tolerances, material fatigue, or other factors that may or may not be foreseeable.
Because many GEAR182 products are intended for professional, tactical, industrial, or demanding environments, customers acknowledge that all equipment is subject to wear over time and requires regular inspection and maintenance. Customers are solely responsible for inspecting every product before each use and periodically throughout its service life. Products should immediately be removed from service if they show any indication of cracking, excessive wear, loose hardware, deformation, discoloration, delamination, material degradation, or any other condition that could affect the product’s strength, function, or safe operation.
Customers are solely responsible for determining whether a product is suitable for their intended application. GEAR182 cannot evaluate the unique circumstances, equipment configurations, environmental conditions, or operational requirements under which each product will be used. By purchasing and using our products, customers acknowledge that they have independently determined the product is appropriate for their intended use.
Products sold by GEAR182 are intended only for lawful purposes and must be used in accordance with all applicable laws, regulations, workplace policies, and manufacturer recommendations. Customers are responsible for ensuring that the products they purchase are legal to possess, import, own, carry, and use within their jurisdiction.
Products must never be modified, altered, drilled, cut, heated, chemically treated, painted with incompatible coatings, or otherwise changed unless expressly authorized by GEAR182. Unauthorized modifications may significantly reduce product performance and structural integrity and immediately void any applicable warranty.
To the fullest extent permitted by applicable law, GEAR182 shall not be liable for any injury, illness, death, property damage, equipment damage, lost income, lost business opportunities, business interruption, loss of data, incidental damages, consequential damages, indirect damages, special damages, punitive damages, or any other losses arising directly or indirectly from:
- The use or misuse of any product;
- Improper installation or assembly;
- Failure to inspect or maintain the product;
- Normal wear and tear;
- Product fatigue or material degradation;
- Exposure to excessive force, impact, chemicals, heat, cold, moisture, ultraviolet light, or environmental conditions;
- Unauthorized repairs or modifications;
- Improper storage or transportation;
- Accidental damage;
- Failure of associated equipment or third-party products used with our products;
- Use outside the product’s intended purpose; or
- Any failure, malfunction, or breakage occurring during normal or abnormal use.
Customers understand and acknowledge that many GEAR182 products may be used in physically demanding occupations or environments, including but not limited to law enforcement, corrections, healthcare, security, emergency services, military, industrial workplaces, and outdoor activities. The customer voluntarily assumes all risks associated with the ownership, installation, handling, transportation, maintenance, and use of any product purchased from GEAR182.
GEAR182 does not guarantee that any product will prevent injury, protect equipment, or perform without failure under all conditions. No product should ever be relied upon as the sole means of preventing injury, securing equipment, or ensuring personal safety.
Except where prohibited by law, GEAR182’s total liability arising out of any claim relating to any product shall be limited to the original purchase price paid for that specific product. Under no circumstances shall GEAR182 be liable for any amount exceeding the purchase price of the product that is the subject of the claim.
Nothing in this notice excludes or limits any rights or remedies that cannot legally be excluded or limited under the applicable consumer protection or product liability laws of the Province of Ontario, Canada, or any other jurisdiction where such laws apply.
By purchasing, possessing, installing, or using any GEAR182 product, the customer confirms that they have read, understood, and accepted this notice, acknowledge the inherent risks associated with the use of physical equipment, and agree to use all products responsibly, safely, and in accordance with applicable laws and accepted safety practices.
